Proprietary Rights in Content on Pokerspace

Top

Pokerspace.com does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials (collectively, "Content") that you post to the Pokerspace Services. After posting your Content to the Pokerspace Services, you continue to retain all ownership rights in such Content, and you continue to have the right to use your Content in any way you choose. By displaying or publishing ("posting") any Content on or through the Pokerspace Services, you hereby grant to Pokerspace.com a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content solely on and through the Pokerspace Services.
Without this license, Pokerspace.com would be unable to provide the Pokerspace Services. For example, without the right to modify Member Content, Pokerspace.com would not be able to digitally compress music files that Members submit or otherwise format Content to satisfy technical requirements, and without the right to publicly perform Member Content, Pokerspace.com could not allow Users to listen to music posted by Members. The license you grant to Pokerspace.com is non-exclusive (meaning you are free to license your Content to anyone else in addition to Pokerspace.com), fully-paid and royalty-free (meaning that Pokerspace.com is not required to pay you for the use on the Pokerspace Services of the Content that you post), sublicensable (so that Pokerspace.com is able to use its affiliates and subcontractors such as Internet content delivery networks to provide the Pokerspace Services), and worldwide (because the Internet and the Pokerspace Services are global in reach). This license will terminate at the time you remove your Content from the Pokerspace Services. The license does not grant Pokerspace.com the right to sell your Content, nor does the license grant Pokerspace.com the right to distribute your Content outside of the Pokerspace Services.
You represent and warrant that: (i) you own the Content posted by you on or through the Pokerspace Services or otherwise have the right to grant the license set forth in this section, and (ii) the posting of your Content on or through the Pokerspace Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by you to or through the Pokerspace Services.
The Pokerspace Services contain Content of Pokerspace.com ("Pokerspace.com Content"). Pokerspace.com Content is protected by copyright, trademark, patent, trade secret and other laws, and Pokerspace.com owns and retains all rights in the Pokerspace.com Content and the Pokerspace Services. Pokerspace.com hereby grants you a limited, revocable, nonsublicensable license to reproduce and display the Pokerspace.com Content (excluding any software code) solely for your personal use in connection with viewing the Pokerspace Website and using the Pokerspace Services.
The Pokerspace Services contain Content of Users and other Pokerspace.com licensors. Except for Content posted by you, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the Pokerspace Services.

Content Posted

Top

Pokerspace may delete any Content that in the sole judgment of Pokerspace violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. Pokerspace assumes no responsibility for monitoring the Pokerspace Services for inappropriate Content or conduct. If at any time Pokerspace chooses, in its sole discretion, to monitor the Pokerspace Services, Pokerspace nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content.
You are solely responsible for the Content that you post on or through any of the Pokerspace Services, and any material or information that you transmit to other Members and for your interactions with other Users. Pokerspace does not endorse and has no control over the Content. Content is not necessarily reviewed by Pokerspace prior to posting and does not necessarily reflect the opinions or policies of Pokerspace. Pokerspace makes no warranties, express or implied, as to the Content or to the accuracy and reliability of the Content or any material or information that you transmit to other Members.

PS Points

Top

Pokerspace Points (“PS Points”) are a form of reward points that Users can accumulate while playing games or interacting socially with other Users within Pokerspace or its affiliate network. They may also be referred to as a “virtual currency” on the Pokerspace, though this does not mean that they have any legal tender or financial guarantee.
PS Points are normally earned by interacting on the community, completing specific activities, and participating in other social functions within Pokerspace. PS Points may also be obtained by successfully completing certain surveys or participating in certain promotions and offers made available through our partners and affiliates. We provide a limited number of free PS Points to all new Users of the Pokerspace so that they understand exactly what PS Points are, and what they are used for. We reserve the right to charge fees for the right to use PS Points and to distribute PS Points without charge in our sole discretion. You agree that we have the absolute right to manage, regulate, control, modify and/or eliminate PS Points as we sees fit in our sole discretion, and that We will have no liability to you for exercising such right. PS Points cannot be refunded, returned or redeemed for any sum of money or monetary value under any circumstances.
You can spend your PS Points on functions and items within the Service or use them to participate in games. Once PS Points have been lost or spent, they will be subtracted from your account and cannot be refunded or returned.
We will make efforts to maintain the PS Points associated with your account, including performing regular backups and instituting web security procedures. However if there is a loss of PS Points in your account due to technical or operational problems with the Service, we will refund you the lost Peanuts once the loss has been verified.
You agree that in under no circumstances are we liable to you for any damages or claims that may arise from the loss or use of your PS Points. Without limiting the foregoing, our maximum liability or responsibility to you is to refund the PS Points lost. If the Service is due to permanently close, or become unavailable for an extended period of time (e.g., more than 24 hours), we will use reasonable efforts to notify you in advance.
We are not responsible for any apparent loss of value that may result from a loss of your PS Points regardless of the circumstances. You absolve us of any responsibility to maintain or update your PS Points. Your PS Points in such a case may be permanently lost without any liability to us.

Forum Rules of Conduct

Top

  1. You must have an active Pokerspace account to post on our forums.

If you are suspended or banned from Pokerspace, you will not be able to post.

  2. Post constructively

Negative feedback can be very useful, provided that it is presented in a civil, factual manner. Tell us what you don't like and why and how you feel it could be improved. Posts that are insulting and rude may be deleted, no matter how valid the ideas behind them may be. Negative feedback posted in a non-constructive manner will not be tolerated and your account will be suspended.

  3. Screenshots may not be posted

In order to provide optimum forum performance for our users, the posting of screenshots is prohibited in the forum. You may provide links to screenshots you have hosted elsewhere. We encourage you to use the HandPostingsTM feature to post hands.

  4. Posting images on the forums is prohibited with the following exceptions:

Signature graphics are permitted, but must follow these guidelines: signature graphics that may only contain your character name, corporation logo, corporation or personal slogan or other text that is directly related to your poker profile, or content directly related to Pokerspace. All content must be in good taste.

    Additional restrictions are as follows:

    • No more than one signature image may be used
    • Maximum height: 120 pixels
    • Maximum width: 400 pixels
    • Maximum file size: 24,000 bytes (not Kbytes)

  5. Be respectful of others at all times

The purpose of the forum is to provide a platform for the exchange of ideas. Occasionally, there will be conflicts that arise when people voice opinions. Be courteous when disagreeing with others. It is possible to disagree without being insulting.

  6. Ranting is prohibited

A rant is a post which is long-winded, redundant and filled with angry, non-constructive comments. A free exchange of ideas is essential to building a strong sense of community, but rants are disruptive and incite personal attacks and trolling. Please post your thoughts in a concise, clear manner and avoid going off on rambling tangents.

  7. Personal attacks are prohibited

Personal attacks are posts which are designed to personally berate or insult another. Text of this nature is not beneficial to the community spirit and will not be tolerated.

  8. Trolling is prohibited

Trolling is the word used to describe a post that is deliberately designed for the purpose of angering and insulting the members of the forum community. Posts of this nature are disruptive and do not convey a friendly attitude.

  9. No posting of personal information

Please respect the privacy of other Pokerspace players and do not give out information such as phone numbers and addresses.

  10. Private communication between the Pokerspace Team members, moderators and administrators of the forum and the forum users is not to be made public on these forums or by any other venue.

You are not permitted to publicize any private correspondence received from any of the aforementioned.

  11. Warnings and bans are not to be discussed on the forum

Such matters shall remain private between the Pokerspace and the user. Questions or comments concerning warnings and bans will be conveyed through e-mail or private messaging. Likewise, discussions regarding moderator actions are not permitted on the forum. If you have questions regarding a post or thread, please contact support@pokerspace.com

  12. Immediate banning from the forum can result from any of the following:

The posting of pornography; discriminatory remarks which are sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive; excessive obscene or vulgar language; posts which discuss or illustrate illegal activity; providing links to sites that contain any of the aforementioned.

  13. Spamming, bumping and pyramid quoting are prohibited

Spam is considered to be repetitive posting of the same topic or text or nonsensical posts that have no substance and are often designed to annoy other forum users. Bumping posts in order to keep them near the top of the list is also prohibited. Pyramid quoting is a response to a forum thread which contains the quotes of four or more previous posters, sometimes with additional spaces added unnecessarily. Posts of this nature are not conducive to community spirit and are unwelcome.

  14. Do not post about bugs and exploits

Bugs and exploits should be reported through the proper method by filing a report for our Quality Assurance department. You can find the form here.

  15. Redundant threads will be deleted

As a courtesy to others before beginning a new thread, please look to see if an active thread on that topic has already been established. If so, place your comments there instead. Multiple threads on the same subject clutter up the forum needlessly and many good ideas may be lost. Keep discussions about one topic to one thread only.

  16. Impersonating another forum user, moderator, volunteer, administrator or Pokerspace employee is strictly prohibited

You are expressly forbidden from impersonating anyone else, including those named above, on the forum or in anywhere else on Pokerspace. This may be grounds for permanent loss of your Pokerspace account.

  17. "Newbie" bashing will not be tolerated, particularly in the Newcomer's Forum

New forum members are encouraged to use, but not restricted to, the Newcomer's Forum. The Newcomer's Forum is specifically designed to provide a platform for those who are new to the Pokerspace community to ask questions and learn more about the site. Regular forum users are encouraged to be helpful and courteous in their responses.

  18. You may not post advertisements

Posts discussing or linking to commercial websites other than Pokerspace are strictly prohibited.

  19. Avoid using profanity

Using partial masking (such as asterisks or punctuation marks) to bypass the profanity filter is prohibited and will result in the same action as if the actual word had been typed.

  20. Disputes which cannot be resolved between forum users and moderators may be arbitrated by the forum administrators.

To discuss problems or concerns, please send an e-mail to: support@pokerspace.com
